Disclosures & Disclaimers
Last updated: October 30, 2026
Goldsmith Associates PLLC (“Goldsmith”) respects your privacy, whether you read our insights, contact our attorneys, or visit goldsmithpllc.com (the “Site”). The legal notices below set the terms on which the Site is offered. The privacy policy explains what we collect, why we collect it, who receives it, and which choices remain yours. The cookie policy explains the technologies that collect it, and the fraud alert explains how to spot criminals who pose as Goldsmith.
Attorney Advertising
The Site is attorney advertising under the rules of professional conduct of New York, Texas, Tennessee, and Oklahoma, and so is every article, alert, video, post, and email that Goldsmith publishes to describe its services. Nothing on the Site is a solicitation of any person in a jurisdiction where the firm or its attorneys aren’t authorized to practice, or where this content wouldn’t comply with that jurisdiction’s rules.
Prior Results
Prior results do not guarantee a similar outcome. Every transaction, demand, and dispute turns on its own documents, counterparties, market conditions, and facts, and a result the firm achieved for one client says nothing certain about the result it can achieve for another. References on the Site to deals closed, assets conveyed, clients represented, years of experience, or closing rates describe the firm’s history, not a prediction or a promise.
Responsible Attorney
Jason Goldsmith, Managing Member of Goldsmith Associates PLLC, is the attorney responsible for the content of the Site. The firm’s principal office is at 100 Crescent Court, Suite 700, Dallas, Texas 75201, and the firm also keeps an office at 14 Wall Street, 20th Floor, New York, New York 10005. Questions about any statement on the Site may go to info@goldsmithpllc.com or 833-4-GOLDSMITH.
Terms Acceptance
Using the Site means accepting these legal notices, the Privacy Policy, the Cookie Policy, and the Fraud Alert, as each may be revised. Anyone who doesn’t accept them should not use the Site. They apply to every page, article, video, calculator, and form on goldsmithpllc.com and to any page that links to them.
General Information
Articles, insights, answers, videos, calculators, and other content on the Site are general information about the mortgage market and the laws that govern it, not legal advice about any particular situation. Content may not reflect the most recent legal developments, may not apply in every jurisdiction, and isn’t a substitute for advice from an attorney who knows the facts. No one should act, or decide not to act, on anything here without first consulting counsel licensed in the relevant jurisdiction.
No Engagement
Visiting the Site, reading its content, following the firm on social media, calling, emailing, or submitting a form doesn’t create an attorney-client relationship with Goldsmith or any of its attorneys. A relationship begins only after the firm clears conflicts, agrees to the representation, and confirms the engagement in a written engagement letter signed by the client and the firm. Until then, the firm has no duty to act, no obligation to track any deadline, and no responsibility for any matter.
Confidential Information
Please don’t send confidential or time-sensitive information through the Site, by email, or by phone before Goldsmith confirms a representation in writing. Information sent without an engagement may not be treated as confidential or privileged, may not reach the right person in time, and may not prevent the firm from representing another party in the same matter, including a party adverse to the sender. Email and web forms also travel over networks the firm doesn’t control, so their security isn’t guaranteed.
Bar Admissions
Jason Goldsmith is admitted to practice law in New York, Texas, Tennessee, and Oklahoma. Each attorney and professional of the firm practices only where admitted or otherwise authorized, and the firm advises on the law of other jurisdictions only as the applicable rules allow, which may include working with local counsel. Bar association logos on the Site show membership or admission, not an endorsement by any bar association.
No Certification
No attorney at Goldsmith is certified as a specialist by the Texas Board of Legal Specialization, by the Tennessee Commission on Continuing Legal Education and Specialization, or by any other certifying organization. References on the Site to the firm’s focus, experience, or knowledge of the mortgage market describe the areas in which the firm practices, not a certification or a recognized specialty.
Client Statements
Client statements on the Site are real, used with permission, and describe completed matters. Names and titles are withheld or generalized to protect client confidentiality. Each statement reflects the view of the client who made it, wasn’t paid for, and doesn’t guarantee any outcome for any other client.
Deal Statistics
Deal counts, dollar volumes, client counts, years of experience, and closing rates on the Site come from the firm’s own records as of the last update of the page on which they appear. They may include matters handled by the firm’s attorneys before joining the firm, may be rounded or stated as minimums, and may count a transaction once even when it involved several closings. They describe history, not future performance.
Website Images
Photographs, illustrations, graphics, infographics, and diagrams on the Site are for illustration only. Unless a caption says otherwise, they don’t depict actual clients, transactions, documents, or matters, and anyone pictured other than the firm’s own attorneys and staff isn’t a client of the firm.
Engagement Terms
The scope, staffing, fees, billing, and every other term of a representation are set only in the engagement letter for that matter. Descriptions of services, programs, memberships, and tools on the Site are summaries, may change without notice, and don’t amend, expand, or replace any engagement letter.
Investment Disclaimer
Content about whole loans, mortgage servicing rights, warehouse facilities, securities, and other assets describes legal issues, not investment merits. Nothing on the Site is investment, tax, accounting, or financial advice, a recommendation to buy, sell, or hold any asset, or an offer or solicitation of any transaction. Goldsmith isn’t a broker-dealer, investment adviser, or lender, and a description of a service on the Site isn’t an offer to provide it to any particular person, in any particular jurisdiction, or on any particular terms.
Dated Content
Each article, alert, video, and post speaks as of its publication date. Goldsmith doesn’t undertake to update earlier content when laws, regulations, agency guidance, investor guides, or market practices change, and older content may no longer be accurate or complete.
Outside Links
Links to other websites, including government agencies, investors, regulators, publications, and social media platforms, are provided for convenience. Goldsmith doesn’t control, endorse, or take responsibility for the content, accuracy, privacy practices, or availability of any website it doesn’t operate, and these notices don’t apply once a visitor leaves the Site.
Embedded Media
Videos, maps, and other content embedded from YouTube, Google, LinkedIn, and other providers load from those providers’ servers and are governed by their own terms and privacy policies. Those providers may set cookies or collect information when the content loads or plays, whether or not anyone clicks on it.
Social Media
Posts, comments, and messages on the firm’s LinkedIn, X, YouTube, Instagram, Threads, Reddit, and Google Business Profile accounts are attorney advertising and general information. Following, liking, sharing, commenting on, or messaging those accounts doesn’t create an attorney-client relationship, and the firm doesn’t adopt or endorse anything other people post. Reviews and recommendations on third-party platforms reflect only the views of the people who gave them.
Email Communications
Newsletters, alerts, and article emails from Goldsmith are attorney advertising. Every marketing email identifies the firm, gives its postal address, and offers a way to unsubscribe at any time, and unsubscribing from marketing emails doesn’t affect communications about an existing representation.
Electronic Communications
Visiting the Site or emailing the firm is consent to receive electronic communications from Goldsmith. Electronic notices, disclosures, and records satisfy any requirement that a communication be in writing, except where the law or an engagement letter requires otherwise.
Trademark Notice
Goldsmith, the Goldsmith wordmark and asterisk, and the names and logos of the firm’s services and products are trademarks or service marks of Goldsmith Associates PLLC or its affiliates, whether or not registered. Other names and marks on the Site belong to their respective owners, and their appearance here doesn’t imply any affiliation, sponsorship, or endorsement.
Copyright Notice
© 2026 Goldsmith Associates PLLC. The text, graphics, infographics, videos, calculators, design, and code of the Site are protected by copyright and other laws, and Goldsmith Associates PLLC or its licensors own all rights in them. No content may be copied, republished, adapted, or distributed without the firm’s written permission, except as these notices allow. Anyone who believes content on the Site infringes a copyright may send a notice to info@goldsmithpllc.com. The notice must identify the copyrighted work, the material claimed to infringe it and where it appears on the Site, and the sender’s name, address, phone number, and email address. It must also include a statement of good-faith belief that the use isn’t authorized, a statement under penalty of perjury that the notice is accurate and that the sender may act for the owner, and a physical or electronic signature.
Permitted Use
Visitors may view, download, and print content from the Site for their own informational, noncommercial use, provided every copyright and attorney advertising notice stays intact and the content isn’t altered. Any other use, including framing, mirroring, republishing, reselling, or incorporating the content into another product or service, requires the firm’s written permission.
Automated Access
No one may use robots, crawlers, scripts, or other automated means to copy or collect the Site’s content, other than search and answer engines that index it and link back to the source, or use any of its content to build, train, test, or improve an artificial intelligence model, dataset, playbook, or competing service without the firm’s written permission. Goldsmith may block any access that it believes violates these notices.
Prohibited Conduct
No one may use the Site to break any law; transmit viruses or other harmful code; probe, scan, or test its security; interfere with its operation; impersonate Goldsmith or any of its attorneys; send unsolicited bulk messages; or gain unauthorized access to any account, system, or data connected to it.
Site Monitoring
Goldsmith and its service providers may monitor, record, and log traffic on the Site to keep it secure, investigate misuse, and meet legal obligations, and may share those records with law enforcement when the law allows or requires it.
Service Interruptions
The Site may be unavailable, slow, or incomplete at times because of maintenance, upgrades, network failures, attacks, or events outside Goldsmith’s control. Goldsmith may change, suspend, or discontinue any part of the Site without notice and isn’t liable for any resulting loss.
Visitor Submissions
Comments, ideas, suggestions, and materials sent through the Site, other than information a client sends under an engagement letter, are nonconfidential. Goldsmith may use them for any purpose without compensation or attribution, and each sender confirms that sending them violates no one’s rights.
Access Termination
Goldsmith may restrict, suspend, or end anyone’s access to the Site, or to any part of it, at any time and for any reason, including a violation of these notices.
No Warranties
This website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, and noninfringement. Goldsmith doesn’t warrant that the Site will be uninterrupted, secure, or free of errors, viruses, or other harmful components.
Liability Limits
To the fullest extent the law allows, Goldsmith and its members, attorneys, employees, and affiliates aren’t liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from access to, use of, or reliance on the Site or its content, even if advised of the possibility of those damages. Some jurisdictions don’t allow certain limits, so some of these limits may not apply.
Visitor Indemnity
Anyone who uses the Site in violation of these notices agrees to indemnify and hold harmless Goldsmith and its members, attorneys, employees, and affiliates from any claims, losses, and expenses, including reasonable attorneys’ fees, that result from that use.
Governing Law
These notices and any dispute arising from the Site are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any action must be brought only in the state or federal courts located in Dallas County, Texas, and every visitor consents to the personal jurisdiction of those courts.
Jurisdictional Limits
Goldsmith intends the Site for business professionals in the United States. The firm doesn’t seek to represent anyone in a jurisdiction where the Site wouldn’t comply with local law or professional rules, and it makes no claim that the content is appropriate or available outside the United States.
Severability Clause
If any part of these notices is held unenforceable, that part is limited to the minimum extent necessary and the rest stays in effect. Goldsmith’s failure to enforce any provision isn’t a waiver of it. These legal notices, together with the Privacy Policy, the Cookie Policy, and the Fraud Alert, are the entire terms for use of the Site.
Affiliated Companies
Some services described on the Site are offered with affiliated companies, including LoanTrust and Curativ. Each affiliate is a separate entity with its own terms, an engagement of one isn’t an engagement of another, and an affiliate’s services aren’t legal services unless Goldsmith provides them under an engagement letter.
Website Accessibility
Goldsmith wants the Site to be usable by everyone and works toward the Web Content Accessibility Guidelines 2.1, Level AA. Anyone who has trouble reading or using any part of the Site may email info@goldsmithpllc.com or call 833-4-GOLDSMITH, and the firm will provide the information in another format.
Notice Updates
Goldsmith may revise these notices at any time by posting a new version on this page, and the date at the top of the page shows the latest change. Continued use of the Site after a revision means acceptance of the revised notices.
Contact Information
Goldsmith Associates PLLC, 100 Crescent Court, Suite 700, Dallas, Texas 75201, and 14 Wall Street, 20th Floor, New York, New York 10005. Questions about these notices may go to info@goldsmithpllc.com or 833-4-GOLDSMITH.
Policy Scope
This policy covers what Goldsmith collects through the Site. It also covers the emails, calls, and forms that the Site sends our way. Client information, however, is different. Our engagement terms protect it, and so does our professional duty of confidentiality. Visiting the Site doesn’t create an attorney-client relationship, and neither does reading our content or sending us a message. Until we confirm a representation in writing, please keep confidential information to yourself.
Information Collected
We collect the information you provide: your name, company, title, email address, phone number, and anything else you send us. The Site records your IP address, general location, browser and device type, the pages you view, the time you spend on them, and the site that referred you. Our providers supply the company you work for and, for some U.S. visitors, your name, job title, LinkedIn profile, and business email address. Our providers match visit data with business-profile data they hold. We may also draw on public sources, such as professional profiles and company websites.
Collection Tools
Goldsmith and its service providers use cookies, pixels, and similar technologies in four categories. Essential cookies keep the Site running and secure. Analytics tools show how visitors move through the Site. The LinkedIn Insight Tag measures LinkedIn visits and shows our content to past visitors. RB2B visitor identification names the company visiting the Site and, for some U.S. visitors, the person. LinkedIn and RB2B may collect information about your online activities over time and across different websites.
Information Use
We use this information to respond to you and deliver what you request; to learn who reads our insights, and which topics matter most; to share articles, alerts, and invitations, and to reach relevant professionals on LinkedIn; to keep the Site secure, stable, and working; and to meet our legal, regulatory, and professional obligations.
Information Sharing
Goldsmith doesn’t sell personal information for money. We share it only with service providers that host, secure, analyze, or support the Site and our marketing, under contracts that limit how they use it; with LinkedIn and RB2B, as described above; with authorities and courts, when law or professional rules require it, or when our rights or our clients’ rights need protection; and with a successor firm, if our firm merges or changes form, subject to this policy. Some state laws may treat the disclosures to LinkedIn and RB2B as “sharing” or “targeted advertising,” which is why the choices below include an opt-out.
Your Choices
The Site honors Global Privacy Control. When a browser sends that signal, the advertising and visitor-identification tools don’t load. The older Do Not Track setting, by contrast, has no common standard, which is why the Site follows Global Privacy Control instead. RB2B offers an opt-out from visitor identification at app.retention.com/optout. Your LinkedIn ad settings control how LinkedIn uses your data. Your browser settings block or delete cookies, though the Site needs its essential ones to work fully. The link in every email from us unsubscribes you at any time. Each choice applies only to the browser and device where you set it, so repeat it on each one you use.
Privacy Rights
Depending on where you live, state law may give you rights over your personal information. Those rights can include knowing what we hold, receiving a copy, and having it corrected or deleted. They can also include opting out of targeted advertising, “sales,” and “sharing.” To make a request, email info@goldsmithpllc.com or call 833-4-GOLDSMITH. We verify each request before we act on it. You may use an authorized agent, and you may appeal any decision by replying to our response. We never treat you differently for exercising these rights.
Data Security
Goldsmith protects information with reasonable safeguards: administrative, technical, and physical. No website or transmission over the internet, however, is completely secure. We keep information only as long as these purposes, the law, or our professional obligations require.
Policy Boundaries
The Site serves business professionals, and we don’t knowingly collect information from anyone under 16. Links to LinkedIn, YouTube, and other sites lead to their own privacy practices. We may revise this policy, and the “Last updated” date above shows the latest change.
Contact Information
Questions about this policy may go to Goldsmith Associates PLLC at 100 Crescent Court, Suite 700, Dallas, Texas 75201, or 14 Wall Street, 20th Floor, New York, New York 10005, by email at info@goldsmithpllc.com, or by phone at 833-4-GOLDSMITH.
Cookie Basics
Cookies are small text files that a website stores in a browser so it can recognize the device on later visits. Pixels, tags, and scripts are related technologies that load from the Site or a provider’s server and report what a browser does on a page. This policy calls all of them “cookies,” and it supplements the Privacy Policy, which explains how Goldsmith uses the information they collect.
Cookie Sources
First-party cookies are set by the Site itself. Third-party cookies are set by providers whose tools run on the Site, including Google, LinkedIn, RB2B, and YouTube, and each provider’s own terms and privacy policy govern what it collects.
Cookie Lifespans
Session cookies expire when the browser closes. Persistent cookies stay until they reach their expiration date, which can range from a day to two years, or until the visitor deletes them.
Essential Cookies
Essential cookies keep the Site running and secure, balance traffic, and let forms submit. Google reCAPTCHA, which protects the Site’s forms from automated abuse, sets cookies and collects device and interaction data under Google’s terms and privacy policy. The Site can’t work properly without these cookies, so browser settings that block them may break parts of it.
Analytics Cookies
Google Analytics, loaded through Google Tag Manager, counts visits, traffic sources, pages viewed, and time on each page so Goldsmith can learn which content readers use. Google receives this information and processes it under its own terms.
Advertising Cookies
The LinkedIn Insight Tag lets Goldsmith measure visits from LinkedIn, build audiences of past visitors, and show them the firm’s content on LinkedIn. LinkedIn may connect that activity to a visitor’s LinkedIn account and may collect information about online activities over time and across different websites.
Identification Cookies
RB2B identifies the companies that visit the Site and, for some U.S. visitors, the people, by matching browser and device signals with business-profile data it holds. RB2B may collect information about online activities over time and across different websites, and it offers an opt-out at app.retention.com/optout.
Embedded Video
YouTube videos embedded on the Site may set cookies when the page loads or the video plays, whether or not anyone presses play, and Google processes that information under its own terms.
Privacy Signals
When a browser sends a Global Privacy Control signal, the advertising and identification tools don’t load. The Site doesn’t respond to Do Not Track signals, because no common standard exists for them.
Browser Controls
Most browsers let visitors view, block, and delete cookies, or block third-party cookies only. Each setting applies to one browser on one device, so anyone who uses several browsers or devices must set each one.
Policy Updates
Goldsmith may revise this policy when the Site’s tools change, and the date at the top of the page shows the latest change.
Impersonation Scams
Criminals impersonate law firms, title companies, lenders, and their people to steal money and information, and the mortgage market is one of their favorite targets. They copy names, logos, signatures, letterhead, and email formats, and they can make a message look as if it came from Goldsmith or one of its attorneys.
Wire Instructions
Goldsmith never sends or changes wiring instructions by email, text, or messaging app alone. Before sending money to Goldsmith, or anywhere at the direction of a Goldsmith attorney, call the firm at 833-4-GOLDSMITH, using a number taken from the Site rather than from the message, and confirm the instructions with a person you know.
Email Compromise
In business email compromise, a criminal takes over or imitates a real email account and joins a real conversation, often near a closing, a settlement date, or a funding deadline. A familiar thread, a correct deal name, or an accurate dollar amount doesn’t prove that a message is genuine.
Look-Alike Domains
Goldsmith’s attorneys and staff use email addresses ending in @goldsmithpllc.com only. A message from a similar or misspelled domain, or from a personal email service such as Gmail, Yahoo, or Outlook.com, isn’t from the firm.
Messaging Apps
Goldsmith doesn’t request payments, documents, or personal information through WhatsApp, Telegram, Signal, social media messages, or text messages, and it doesn’t conduct job interviews by chat.
Deepfake Calls
Criminals now clone voices and faces with artificial intelligence. A call, voicemail, or video that sounds or looks like a Goldsmith attorney isn’t proof of identity, so confirm any request for money or information by calling the firm back at a number taken from the Site.
Payment Requests
Goldsmith bills clients only under the terms of their engagement letters. It never asks for gift cards, cryptocurrency, or payment to a personal account, and it never pressures anyone to pay before verifying a request.
Fraud Reporting
Anyone who suspects a fraudulent message should stop responding, keep the message, and call Goldsmith at 833-4-GOLDSMITH. Anyone who has already sent money should call their bank immediately to request a recall, and file a complaint with the FBI’s Internet Crime Complaint Center at ic3.gov.
Firm Limits
Goldsmith can’t prevent criminals from impersonating it, and it isn’t responsible for losses caused by messages, calls, or websites that it didn’t send or operate.
